New Trier passes identity politics-based board policy in conflict with federal executive orders

In February, New Trier formalized its embrace of the controversial tenets of gender theory, which erroneously conflates the idea of gender with sex, by passing a board policy stating “No student shall, based on sex, sexual orientation, or gender identity be denied equal access to programs, activities, services, or benefits or be limited in the exercise of any right, privilege, advantage, or denied equal access to educational opportunities.” (Emphasis ours.)
The school’s policy suggests that a male identifying as a female is officially sanctioned to access a girls locker rooms and even play on girls sports teams.
This policy is in express contradiction with the recent Department of Education (ED) executive order to “defend women’s rights and protect freedom of conscience by using clear and accurate language and policies that recognize women are biologically female, and men are biologically male.” The order later states: ““Sex” shall refer to an individual’s immutable biological classification as either male or female. “Sex” is not a synonym for and does not include the concept of “gender identity.”” Similar executive orders were also issued applying to healthcare law.
So which is it? New Trier’s policy or the Department of Education’s order? How are parents to know which laws to expect their schools to follow and what their rights are amidst these conflicting directives?

Liberty Justice Center filed this complaint with the Defense of Freedom Institute which has resulted in the federal Department of Education’s Office of Civil Rights opening an investigation into Chicago Public Schools and Deerfield schools on Title IX violations, including the issue of allowing males to access female private spaces in schools.
